It’s Probably Time Contest (the “Contest") entrants agree to
be bound by these Official Contest Rules and Regulations ("Rules").
The Contest commences at 5:00 p.m. Eastern Time (“ET”) on February
3, 2009 and ends at 4:59:59 p.m. Eastern Daylight Savings Time (“EDT”)
on March 10, 2009 (the "Contest Period").
SPONSOR: The Contest is sponsored
by CareerBuilder, LLC ("Sponsor"), 200 N. LaSalle Street,
11th Floor, Chicago, IL 60601.
ELIGIBILITY:
The Contest is offered and open only to legal residents of
the fifty United States and the District of Columbia who are eligible
to work in the fifty United States and the District of Columbia, age
18 and older as of the date of entry, who have a valid E-mail address.
The Contest is not open to: (1) employees, independent contractors,
officers, and/or directors of Sponsor,
Sponsor’s respective parent, related, affiliated and/or subsidiary
companies, Sponsor’s advertising, promotion and fulfillment agencies
or Sponsor’s legal advisors, or (2) the immediate family members of,
and persons living in the same household as, any of the foregoing persons.
Any person who has been convicted of, or pleaded guilty to, a crime
may not be eligible to win.
HOW TO ENTER: A) Create a video application not to exceed
forty-five (45) seconds in length explaining Why “It’s Probably
Time” to look for a new job and upload the video application to your
account at http://www.youtube.com. All video applications must
be less than 1GB in any of the acceptable file formats by YouTube at http://www.youtube.com/my_videos_upload. B)
Visit www.itsprobablytime.com during the Contest Period and submit an Official
Entry form including your complete name, address including zip code,
telephone number, your primary e-mail address and the URL of your video
application posted at www.youtube.com
By submitting an Online Entry, entrants: 1) irrevocably
grant Sponsor the royalty-free right throughout the world to use, re-use,
copy, publish, republish in whole or in part, edit, add to, modify,
and rearrange the Online Entry in whatever media, including without
limitation edit, rearrange, and/or copy the Online Entry for use in
the promotion of Sponsor’s products and services without further permission,
consideration or payment to the entrant, except where prohibited; 2)
warrant and represent that Online Entry is 100% original creation/work
by entrant and that use of the Online Entry as described herein will
not violate any law or infringe upon the rights, title, claim or interest
of any third party; and 3) certify that entrant is the creator and sole
copyright owner of the video submitted and has obtained the appropriate
consents of all identifiable persons shown in the submitted photograph
granting permission to the entrant to submit the video containing those
persons likenesses/images. Further, all individuals appearing in the
video must be at least 18 years of age. (A and B defined herein are
collectively, “Online Entry.”) Company names or individual names
other than the Entrant cannot be included in any Online Entry submitted.
Any Online Entry submitted with a company name, an individual name other
than the Entrant’s will be disqualified. Only the name listed on the
Official Online Entry will be deemed the Entrant and will be eligible
for any prize offered in this Contest. All other individuals included
in an Online Entry whose name does not appear on the Online Entry will
not be considered the Entrant and will not be eligible to receive any
prize offered in this Contest. No previously published video clips may
be submitted nor will such a submission qualify as an Online Entry.
All Online Entries become the sole property of the Sponsor and will
not be acknowledged or returned. No correspondence will be entered
into, acknowledged or returned.
All Online Entries must be received by 4:59:59
PM ET on March 10, 2009. Limit one Online Entry per person. Duplicate
Online Entries received will be void. In the event the same video clip
is submitted by more than one entrant, the first Online Entry received
will be accepted and all additional duplicate Online Entries will be
deemed void. Use of automated devices is not valid for entry. Online
Entries must include a valid e-mail address for the entrant. Sponsor
and its respective parent, related, affiliated and subsidiary companies,
advertising, promotion and fulfillment agencies and legal advisors and
their respective officers, directors, agents, employees, and assigns
(collectively, the “Released Parties”) are not responsible for any
problems or technical, hardware, or software malfunctions of any telephone
network or telephone lines, failed, incorrect, inaccurate, incomplete,
garbled or delayed electronic communications whether caused by the sender
or by any of the equipment or programming associated with or utilized
in this Contest, computer online systems, servers or providers, computer
equipment, software, failure of any e-mail or entry to be received by
the Sponsor due to technical problems, human error or traffic congestion,
unavailable network connections on the Internet or at any website, or
any combination thereof, including, without limitation, any injury or
damage to entrant’s or any other person’s computer relating to or
resulting from participating in this Contest or downloading any materials
in this Contest. By submitting an Online Entry, you agree to abide by
the terms of these Rules, the terms of the CareerBuilder Terms
and Conditions, and the CareerBuilder Privacy
Policy. Online Entries that
include profanity, inappropriate, defamatory or explicit language, or
demonstrate any lewd or sexually suggestive gestures or full or partial
nudity and demonstrate the use of alcohol or drug use will be disqualified.
TOP TEN (10) VIDEO FINALISTS:
A total of up to ten (10) “Top 10” Finalists will be selected from
among all Online Entries received. The “Top 10” Finalists will be
selected based on the following judging criteria: Creativity (0-20 points);
Originality (0-20 points); Entertainment Value (0-20 points); Presentation
Level (0-20 points); and Humor (0-20 points). The judging of Online
Entries will be conducted by the Sponsor whose decisions are final and
binding in all respects relating to the selection of all “Top 10”
Finalists. In the event of a tie, the tied Online Entries will be re-judged
by an additional judge selected by the Sponsor who will serve as the
tie-breaker using the same criteria as outlined herein. In the event
an insufficient number of qualified Online Entries is received (as determined
by the judges), this Contest, at the Sponsor’s sole discretion, may
be cancelled. All “Top 10” Finalists will be notified by e-mail,
and overnight mail on or about March 13, 2009. All “Top 10” Finalists
will be required to sign and return an Affidavit of Eligibility, Liability
and Publicity Release by March 17, 2009. Non-compliance will result
in disqualification of such “Top 10” Finalist and the next highest
scoring Entry may become a “Top 10” Finalist. If a “Top 10”
Finalist’s notification is returned as undeliverable, such “Top
10” Finalist’s Online Entry will be disqualified and the next highest
scoring Online Entry may become a “Top 10” Finalist. A potential
Finalist’s failure to sign and return the required affidavits by March
17, 2009 or to comply with any term or condition of these Official Rules
may, at the sole discretion of Sponsor, result in disqualification,
forfeiture of his or her interest as a Finalist, and the next highest
scoring Online Entry will become a Finalist.
Except where prohibited by law, a Finalist acceptance of a Finalist
appointment constitutes permission to use his/her name, voice/testimonial,
hometown, Online Entry and/or likeness/photograph for promotional, advertising
and/or publicity purposes in any media, now or hereafter known throughout
the world in perpetuity, without further notice or compensation.
ONLINE VOTING:
All of the “Top 10” Finalists will be featured at www.itsprobablytime.com between 5:00 p.m. EDT on March 24, 2009 and
4:59:59 p.m. EDT on April 7, 2009 (the “Contest Voting Period”).
Individuals who go to www.itsprobablytime.com during the Contest Voting Period will be asked
to view the “Top 10” Finalist Video Applications and vote for their
favorite.
PRIZE WINNING
CRITIERIA: The Grand Prize Winning Entry will be determined by the
Finalist Entry that receives the highest number of votes during the
Contest Voting Period. In the event of a tie, the Grand Prize Winner
will be determined by the number of votes received during the Online
Voting Period and the Finalist’s original score to be deemed a “Top
10” Finalist. The First and Second Prize Winning Entries will be determined
based on the highest number of votes received during the Contest Voting
Period and the original score to be deemed a “Top 10” Finalist.
In the event of a tie, the tied entrants will be judged by an additional
judge selected by the Sponsor who will serve as the tie-breaker using
the same criteria outlined in the Top 10 Video Finalist section herein.
PRIZES AND THEIR APPROXIMATE
RETAIL VALUE (“ARV”): One (1) Grand Prize: Grand Prize consists
of $5,000 and one (1) Resume Upgrade on CareerBuilder.com. ARV of Grand
Prize: $5,150; One (1) First Prize: First Prize consists of $2,000
and one (1) Resume Upgrade on CareerBuilder.com. ARV of First Prize:
$2,150; and One (1) Second Prize: Second Prize consists of $1,000 and
one (1) Resume Upgrade on CareerBuilder.com. ARV of Second Prize: $1,150.
Total ARV of all Prizes: $8,450.
No substitution, cash redemption for a Resume Upgrade
on CareerBuilder.com, assignment or transfer of any Prize permitted.
Sponsor reserves the right to substitute a prize of equal or greater
value in the event that a Prize is unavailable. Prize winners will be
notified by e-mail, and overnight mail on or about April 9, 2009. All
prize winners will be required to sign and return prize affidavit and
eligibility release forms by April 16, 2009. Prize winners must include
their social security numbers on the prize affidavit and eligibility
forms for tax purposes. Prize Winners are solely responsible for all
federal, state and local taxes on Prize.
USE OF CAREERBUILDER.COM:
By redeeming the Resume Upgrade prize, all prize winners agree and accept
the Terms and Conditions located on CareerBuilder.com. Further, Sponsor
makes no warranties, representations or guarantees, express or implied,
in fact or in law, regarding the effectiveness, performance or use of
the Resume Upgrade. No responsibilities are accepted for any additional
expenses, omissions, delays, re-routing, or acts of any government or
authority.
PARTICIPATION:
Participation in the Contest constitutes an agreement by each entrant
to comply with these Official Rules. These Official Rules will be posted
at www.itsprobablytime.com between February 3, 2009 and April 30, 2009.
Sponsor reserves the right to, in its sole discretion, cancel, modify
or suspend the Contest should any computer virus, bugs or other technical
difficulty or other causes beyond the control of the Sponsor or Released
Parties corrupt the administration, security or proper play of the Contest.
LIMITATION OF LIABILITY:
By entering the Contest, you agree that (1) any and all disputes, claims,
and causes of action arising out of or in connection with the Contest,
or any prize awarded, shall be resolved individually without resort
to any form of class action; (2) any claims, judgments and awards shall
be limited to actual out-of-pocket costs incurred, including costs associated
with entering the Contest, but in no event attorney's fees; and (3)
under no circumstances will you be permitted to obtain any award for,
and you hereby waive all rights to claim, punitive, incidental or consequential
damages and any and all rights to have damages multiplied or otherwise
increased and any other damages, other than damages for actual out-of-pocket
expenses.
CONSTRUCTION: All issues and
questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations
of any entrant vis-ŕ-vis Sponsor, shall be governed by, and construed
in accordance with the laws of the State of Illinois, without giving
effect to any choice of law or conflict of law rules or provisions (whether
of the State of Illinois, or any other jurisdiction) that would cause
the application of the laws of any jurisdiction other than the State
of Illinois. The invalidity or unenforceability of any provision of
these Official Rules shall not affect the validity or enforceability
of any other provision. In the event that any provision is determined
to be invalid or otherwise unenforceable or illegal, these Official
Rules shall otherwise remain in effect and be construed in accordance
with their terms as if the invalid or illegal provision was not contained
herein.
GENERAL RELEASE: By entering
the Contest, you release and discharge Sponsor and Released Parties
from any liability whatsoever in connection with the Contest or with
the acceptance, possession, use or misuse of any prize including, without
limitation, legal claims, costs, injuries, losses or damages, demands
or actions of any kind (including, without limitation: personal injuries;
death; damage to, loss or destruction of property; rights of publicity
or privacy; and defamation or portrayal in a false light). Sponsor and
Released Parties will not be responsible for typographical, printing
or other inadvertent errors in these Official Rules or in other materials
relating to the CareerBuilder.com It’s Probably Time Contest.
